On Legal Supervision Of Financial Holding Company

American's financial supervision system has always been the example of other countries to follow. the outbreak of subprime crisis, sold and bankrupt of many financial holding companies causing many countries, especially America, to introspect their financial supervision system and supervision concept. There's a wide spectrum of opinions on reasons of the outbreak of financial crisis, but undoubtfully, defect of financial supervision system and the lack of effective supervision of financial holding company is a very important and direct element. To begin with the theoretical research of financial holding company, This paper tries to analyze several developed countries, especially American financial holding company's development and supervision system status and its innovation tendency. Thus, we can get some inspiration and valued experience for our supervision department's reference. After all this has been done, this paper tries to give some suggestions on how to innovate and perfect the supervision of our financial holding company.This dissertation consists of four chapters,the main content are as follows:Chapter one introduces the main idea of financial holding company and its supervision, mainly tells the concept and character of financial holding company, supervision importance and pattern of financial holding company. Chapter two point out the deficiency of the supervision of our financial holding company, on the basis of analyzing the current development and supervision position of our financial holding company. Such as lack of law and regulation of FHC, irrational supervision pattern and traditional supevision concept and etc. Chapter three mainly introduces legal supervision status of American,Britain and Japanese financial holding company and its inspiration and significance for the supervision of our FHC. Chapter four is the core part of this paper. Mainly give some suggestion on how to perfect the supervision of our financial holding company. Mainly include: on supervision body, in short time, suggest to perfect"one bank,three committees"supervision coordination mechanism. in the long time, suggest to set up an integrated supervision department. On legislative aspect as how to perfect the supervision of FHC, in transition period, suggest to amend and perfect current financial law and regulation. And finally constitute an integrated <<Financial Holding Company Law>>.
