In 1992,155 countries signed the "United Nations Framework Convention on Climate Change", which is the fundamental legal documentary of the Clean Development Mechanism, after the "United Nations Conference on Environment and Development". "Kyoto Protocol" was brought into effect by legislation on the Third Conference of the Parties of United Nations Framework Convention on Climate Change in 1997. It identified a Clean Development Mechanism on ArticleⅫ. In 2001, "Marrakesh files" was passed on the Seventh Conference of the Parties of United Nations Framework Convention on Climate Change.In abroad, especially Europe and America, there are a large number of deep study on carbon trading. This is the reason that their Emissions Trading System has a sharply development. United States and Australia which do not join "Kyoto Protocol" established the Carbon Trading System contribute to their hard study on Carbon Trading.However, there is not a united group to study on Carbon Trading in our country though some scholars gained many research results, which makes we do not become a strong voice in world in this field.This paper is divided into three parts. The first part (Chapter 1) is an overview about the current international carbon trading market. The second part (Chapter 2 and 3) is to find out the causes of the conflict among the sides of international carbon trading base on the analysis of several essential principles of international environmental law. The third part (Chapter 4) is to seek a road to develop and improve the international carbon trading system.
