Study On Administrative Mediation System

The reason for researching on the administrative mediation is that the issue is of much important theoretical value and practical significance. It is known that, after China reforming and opening up, there have been tremendous and profound changes in whichever terms of economic structure, social system, benefit distribution, ideology, and so on. We are facing the period of combination of opportunities and challenges, as well as developments and conflicts. With the domestic and worldwide advocacy and promotion of the concept of harmonious society, the administrative mediation system has increasingly been one of the important means for administration to resolve the conflicts and disputes. Thus, it needs to build and improve the administrative mediation system microcosmically and macroscopically. As a nature of quasi-judicial administrative system, the establishment and improvement of the administrative mediation will enrich the ways and contents of the administration, will help to resolve the disputes completely, to maintain a stable social order, to reduce the burden of judgments and save the judicial resources, furthermore, to build and prefect our multivariate legal dispute resolution system. Therefore, this issue is highly significant to prefect and to enrich the contents of administrative mediation, maintain the social stability and development, and build the harmonious society.This issue is divided into five parts to comprehensively and systemically introduce and provide some constructive suggestions for perfecting the administrative mediation system. The detailed contents are as follows:The first part is "the research on the basic concept and types of mediation". It mainly discusses the concept of mediation, the origin of mediation in the Chinese history, and the current several Chinese mediation systems:the diverse scholarly understandings of the mediation system; the changes of the mediation system in China since ancient times; the political, economic, and cultural foundation of the mediation system; the current Chinese mediation systems such as people mediation, administrative mediation, judicial mediation and big mediation. In short, the first part is the discussion of the background of the mediation to make people understand the mediation system.
