Research On The Chinese Legal Family And Its Disintegration Reasons

The Chinese legal family is born in the Chinese native place, and it's the crystallization of the Chinese nation's wisdom and ration. It is one of the top five legal families in the world and respected for its glorious history, rich connotation, bright characteristics and far-reaching influence. But it was disintegrated in the flood of repairing laws in late Qing dynasty. The Chinese legal family shows our nation's great creativity and profound legal culture. It is useful for our comprehensive understanding of the socialist legal system with Chinese characteristics and helpful for us to enhance our national pride. Besides it inspires the whole nation's self-confidence to build a great country. However there are few researches on disintegration of the Chinese legal family and its reasons in modern times. This kind of research also has profound referential significance to our legal system construction and development.This paper is divided into four parts.The first part analyzes the formation and development and characteristics of the Chinese legal family.The second part introduces environment changes in China, Japan, Vietnam and Korea after the Opium War and reveals the effect of modernization to the Chinese legal family.The third part analyzes the disintegration reasons of the Chinese legal family and this is the core of the whole paper. There are internal and external reasons that lead to disintegration of the Chinese legal family. And contradictions in itself also contribute to its disintegration. Internal reasons include closure and conservative of the Chinese legal family. External reasons include domestic economic, political, ideological culture and invasion of western capitalist.The fourth part tries to summarize historical implications of disintegration of the Chinese legal family.
