The Study On The Role Of The People's Congress And The Standing Committee In Emergency Management

In accordance with the basic theory of morden public management science, an efficient public management system should be including the government, social organizations and the citizens. In this article, the author points that People Congress is also an important responsible organ in emergency response. It is true that the government takes the main responsibility for emergerncy response. Nevertheless, the National People's Congress, as the highest organ of state power, should also play an active role in the emergency response in that it is entitled the power of legislation, supervision and the function to communicate with public.The article refers to the concept of relative subjects like public crisis management science, political science, the science of law, etc. It discusses People Congress'functions in emergency, including perfecting national public crisis management legal system by legislation; improving government ability on administrating according to law and managing public crisis by supervision; keeping social stabilization by ensuring people's right to know and communicating with public.There are five parts in this article. The first part makes a description of the purpose and the purport of the study and introduces the latest studies in this area both in country and overseas. The second part clarifies the defination, the types and the characteristic of'emergency'. It discusses the relations between People's Congress and other responsible organs like Communist Party, the Government and the Public in emergency response. The article also points out the ways of People Congress to perform its functions: providing legal guarantee in emergency response, enforcing supervision in emergency response and improving communication with public in emergency response. The third part quotes the cases of SARS crisis and Lotus Apartment collapse accident in Minhang District to analyse the present situation of People's Congress in emergency response and to point out its shortcomings in area of legislation, supervision and communication with public. The fourth part summarizes the experiences and successes of legislation, supervision and communication with public in National Congress of western countries. The last part gives some suggestions in three aspects: setting up and improving national public crisis management legal system through better legislation, innovating new forms of supervision for better supervision, paying much attention on people's right to know for a better communication channel. It suggests that People Congress should perfect legislation function, implement rigidity supervision method, strengthen information construction as well as improve connection between deputies and voters.
