Construction Of Modern University System Of Legal Thinking

Modern University System is a generally interested case in our current higher education research, and also be cared by scholars who are from law, management and economics. However, the current research about modern university system in our country is mainly based on the view of branch of instruction; few of them based on the view of law, mainly based on the research of university standard as lack of research of system standard. So, the writer tried to research modern university system based on the view of law, and tried to find the effective way of constructing the modern university system by studying the change of power structure in our universities.Analyses in this article are mainly on university system in a narrow sense as university internal construction. It separated power structure of our university system into politics power structure, administration power structure, academic power structure and society power structure. The writer analyzed mainly on the problems in the management of our universities caused by the inappropriate power structure, such as inappropriate internal power structure and over administration.According to the analysis of statement of our university system and the comparison with western modern university system, the writer gives several assumptions about building our modern university system. Firstly, according to Abstraction of National Middle-to-long Term Education Reformation and Development (year 2010-2020), to clear the position of target value; secondly, to suggest to reform our university power structure:insist and improve president response system under the management of party committee; to found college affairs committee, and to build Chinese special president election system, also to move down the administration power for building college administration system which is adapt to our country; to improve teacher committee and student committee, and to use each kind of student organizations to build suitable society power system of our country. And then, to improve every law of higher education, create university rules, build horizontal management conceptions to complete the change of management.The writer think, modern universities should be under the macroscopically administration of government, we should insist that running college legally, managing, developing and restricting by themselves, to build the college administration system as leaded by party committee, responded by president, academic affairs by professors and democratic management. In order to build our modern university system it must be continually improved as every education law, statute, rule and university regulation which belongs to soft law and very important, to reform university power structure according to the law, to make politic power, administration power and academic power balanced and restrict to each other, and emphasize society power, to enhance democratization of college management. Only this, it could make our modern university system have Chinese feature, scientific and advanced, improve our higher education quality entirely.
