The theory of Confucius and Mencuis,don't mention the right of resistance explicitly,but it can be the latest source of resisting right.In west,the natural law had discussed the theory of resisting right.Under the instruction of natural law and constitutionlism,some western countries had put the resisting right into their constitions.China still don't put the resisting right into her constition,however,it had happened some events in practise,how to solve these problems? The context consists of four parts:the first part had expounded the theory source of resisting right from East and West angle,the concept of resisting right and characteristics;the second part had elaborated the theroy basis from liberalism,social compact,civil society and citizenship,clarified the legitimacy of resisting right; the third part had inspected the regulations of the western countries and the revelation to China; the last part, globalization, hegemonism and rerrorism had happened in international community, and some violences had happened in domestical society, so that the main body and the object of resisting right had changed, on the basis of changing, I has new ideas about the right of resistance.
