Since 80, the 20th century, as an emerging industry, genetically modified technology developed rapidly. With the sustainable expand of genetically modified crops acreage, the number of varieties of genetically modified crops is increasing. Currently, there were dozens of kinds of transgenic crops have been applicant into industrial production, which enabling to promote the economic development and social progress. Under the impetus of the transgenic crops industrialization development, China has made great progress in biotechnology; especially the transgenic rice research has made remarkable achievements in the world. In 2009, China won the application of national security certificate of transgenic rice which marks China will plant the industrialization of transgenic rice in the future, which has a significant impact to the genetically modified crops application in China even in the whole world.However, many problems emerging in the process of genetically modified crops industrialization has also led many people to worry about the issue of the co-existence between genetically modified crops and non -genetically modified crops. The co-existence between genetically modified crops and non -genetically modified crops is a major issue in the genetically modified crops industrialization in China, is also a global hot issue of common concern. So it is significant to research the harmonious development between genetically modified crops and non-genetically modified crops, which is a milestone to the industrialization of transgenic rice in China. The related existing legal system in China has not effectively addressed the issues of infringement of consumers' informed choice rights, ecological risk and trading risk and other issues in the process of industrialization of genetically modified crops. Therefore, we should explore for co-exist legal system between genetically modified crops and non-genetically modified crops with the actual situation in our country, which to guarantee the harmonious development between genetically modified crops and non-genetically modified crops. This research mainly launches the elaboration from the following aspects.First of all, start with expounding the basic concept of genetically modified crops, non-genetically modified crops and co-existence, analysis the theoretical basis of the co-exist legal system between genetically modified crops and non-genetically modified crops in China combined with the theories of ecology, environmental resources, economics and the laws.Secondly, explore practical experience reference to China through anglicizing and summarizing the legislative practice and the system operating experience of co-exist legal system between genetically modified crops and non -genetically modified crops in the United States, European Union, Japan and other representative countries, which providing a useful reference to construct the co-exist legal system between genetically modified crops and non -genetically modified crops in China.Thirdly, combined with empirical research, inspect the existing legal systems in promoting co-existence between genetically modified crops and non -genetically modified crops in China, to explore the difficulties of our existing legal systems in response to the issue of co-existence between genetically modified crops and non-genetically modified crops, which providing the realistic basis to construct the co-exist legal system framework between genetically modified crops and non -genetically modified crops in China.Finally, establish co-exist legal system framework between genetically modified crops and non -genetically modified crops in China from the regulations' idea and the principle, which promoting the rational, sustainable and harmonious development of modern biotechnology.
