The Study On The Intellectual Property Right Protection Of Hubei Mashroom Industy

Hubei province boasts unique advantage in its natural resources as well as a long history of planting the mushroom, coming out among the top in China for mushroom's production scale, planting technology, product quality and export volume. Mushroom industry has been a competitive characteristic agriculture industry in the main productive region and a flagship industry promoting farmers'income increase and rural economic prosperity. However, our province has a weak sense of intellectual property protection and protected type is unitary relatively, a complete intellectual property protection system thus has not yet been established, which goes against the healthy development of mushroomThis paper includes five chapters, which discusses the current situation of intellectual property right protection, the types of intellectual property right protection, the intellectual property right protection in very link, and the idea of perfecting the intellectual property protection of mushroom etc.Chapter One: introduces regulations of intellectual property right protection of mushroom , and compares China's intellectual property right protection methods of mushroom with that of the foreign countries such as Japan, America, European countries, etc.Chapter Two: states current situation of mushroom and the public policies and local regulations for intellectual property right protection of mushroom in Hubei province, and analyzes the existing problems of intellectual property right protection of mushroom and the reasons. It concludes that the main problems are the protected type is unitary and a complete intellectual property rights system has not been established, and the reasons are the non-standard management in fungus varieties, lack of scientific researches, low processing degree, weak sense of intellectual property rights protection, etc.Chapter Three: this chapter is the core part of the paper. It analyzes the brand protection of mushroom by using the geographical symbols, geographical symbol certification brand and collective brand, and gives statements in the intellectual property protection of mushroom in Hubei province, compares the differences between the Patent Law and the Law on the Protection of Plant New Varieties in the mushroom variety protections, and last states the business secret protection of mushroom industry.Chapter Four: this part mainly introduces the intellectual property right protection in very link from cultivating and producing to processing and marketing, analyzes the technique characteristics in each link and accordingly recommends the corresponding intellectual property protection method for each link.Chapter Five: brings forward the idea of perfecting the intellectual property protection of mushroom, ,i.e.,regular the technical standard in this industry, carry out the strategy for brand developing and strengthen relevant policies and measures.
