Construction Of The Inspection And Supervision System Of Civil Affairs's Implementation

Civil Enforcement is the important means to achieve the court judgments and orders in force. If can be achieved, related to the legal rights of the parties or the Third Party, also related to the authority of judicial decisions and the fair of legal system. Since the imperfect system of legal supervision, a widespread problem is the difficult and arbitrary of Civil Enforcement, so resulting in the parties or the Third Party whose rights are prejudiced without an effective remedy, and the people's trust in justice to further reducing, and then affect social stability, all that can be the main causes in groups events in recent years. Traced is the lack of inspection and supervision is an important reason for the current phenomenon of arbitrary of Civil Enforcement. This article according to explore constructing the best way for inspection and supervision of Civil Enforcement as the starting point, compiled the existing theoretical research, based on case study, proposed China should make clear the prosecution have the right to supervision of Civil Enforcement.This article is divided into four parts, first is an overview of the inspection and supervision of Civil Enforcement system, introduced the concepts, characteristics and role of the inspection and supervision of Civil Enforcement, and also briefly discusses the system of associated. Followed is the status and analysis of the constraints, inspect on China's current situation, analyzed the reasons for the unsatisfactory result. Then is the analysis of the necessity and feasibility, pointing out that construct system for inspection and supervision of Civil Enforcement has practical operability. Finally is the constructing of system for the inspection and supervision of Civil Enforcement , this is the focus of this paper, analyse a range of issues in Civil Enforcement ,and put forward my views based on the existing research.
