Research On The Legal System On China's Occupational Disease Diagnosis And Appraisal

In recent years, occupational disease has become more and more serious. Ithas not only brought injury upon the patients and the whole families, but alsobecome an urgent social problem to be solved. Occupational diseasediagnosis and appraisal of these events expose the original settings have beendifficult to adapt the system of social-economic development.Facing the severe situation, improvement has been done to occupationaldisease diagnosis and appraisal due to occupational disease prevention andcure law amendment. This paper analyzed and summarized the concepts,legal values and nature of the occupational disease diagnosis and appraisallegal system. I try to combine the reality and China existing regulations, andfind that there are still some problems of existing system such as the scope ofthe disease list is too small, diagnosis time is unlimited, abuse of rights etc. So, I suggest that make better of the occupational disease diagnosis andappraisal legal system to establish a comprehensive occupational diseasediagnosis and appraisal of mechanisms to safe guard the lawful rights andinterests.
