The Employee's Right Protection From The The Occupational Disease Aspect

With China's rapid economic development, large-scale social production bring us enormous material wealth, associated with occupational disease which both harmful to individual as well as to social. Due to the large population, imbalance of economic development, imperfect laws and regulations and so on reasons, violation to labor rights usually happens, labor rights protection tends to be very hard.This paper illustrates and analyses how to prvent occupational disease and how to protect the rights of employee who suffering from occupational diseases, to look into the protection of rights and interests of workers in China, and some suggestions on how to protect it. This paper consists of four parts.Chapter one makes a brief illustration on the occupational diseases and protection to labor rights. Through the concept and hazards of occupational diseases, elaborate the importance of the prevention and treatment of occupational diseases and protection of rights and interests.Chapter two introduces the status of protection to labor rights on occupational disease aspect in domestic and abroad. Objective and reality describes the present situation of prevention, security system to occupation disease and maintain rights and interests of employees in China. In addition, take the United States and Germany as mainly examples, introduce their achievements on prevention and treatment of occupational disease.Chapter Three points out the shortage of protection the rights and interests to employee who suffered occupational disease by analysis the present situation in China: Firstly, the imperfect in law and regulation, Secondly, supervision and management by relevant government departments has not been practiced well. Finally, social security system to occupational disease is imperfect.Chapter four, after the analysis of the previous chapters, make proposals on protection of labor rights from the occupational diseases aspect. Some solutions and improvement methods also illustrated aim at the shortage of protection to employee on occupational disease side.
