Legal Research On Rural Land Contractual Management Rights Transfer

As the cornerstone of change of rural land system, the reasonable design and benign operation of land contracting management right definitely plays a crucial role in dealing with the issue of agriculture, rural areas and peasants. However, as the development of socialist market economy and the reform of land system, the transfer of the contractual right of land in which decentralized management is the main characteristic exposes many penalties. Thus, ameliorating the transfer of the contractual right of land is the only way leading to solve the phenomena of desolation of farmland, to realize the intensive use of land and to promote the industrial management of agriculture.This thesis firstly begins from the transfer of the contractual right of land of our country, introduces the current phenomena of the transfer of the contractual right of land and then concisely analyzes questions in the legislation and practice of the transfer of the contractual right of rural land, such as lack of standardization in transfer procedure and way, lack of the supervision legislation, imperfection of dispute settlement system and intermediary structures. Again, the author puts forward the countermeasures, such as improving the relevant laws and regulations, standardizing the procedure of land transfer, establishing and adjusting intermediary structures of rural land transfer and building rural social security safety net. At last, this article analyzes the existing problems in the transfer of the contractual right of rural land in Harbin, and puts forward specific solutions to solve those problems, aiming at helping to research the transfer of land.
