On the transfer of land rights in rural areas there is a lot of debate in all aspects, in the context of civil law, mainly whether the right to freedom of circulation, which rights should be taken to transfer mode, dedicated to any other rural land management point of view of government departments. In this paper, the Chinese system and the system of analysis and comparison of Japan, proposed that the present system of China's rural land contracting problems and proposed some solutions. From Japan to see the economic development of rural land use right of free circulation of this view is right. Also, because of the special nature of agricultural land, restrictions on the transfer of rights is also needed. Today, rural economic development and improve the living standards of farmers is one of the most important issue, the existing system in Japan should be part of some worth learning. However, later with China's rapid economic development, it should be flexibility to modify the system. Reference to the situation in Japan, to foresee the rapid economic development has caused some problems.
