On Patients' Informed Consent Rights System Perfect

Informed Consent(IC) is a basic patients'right of requesting for adequate medical information to make a medical decision. Although China has basically established an IC legal system, the system is running with problems. This paper uses a variety of analysis system to improve the IC system which based on the reality of our country.This article is divided into three parts, roughly as follows:The first chapter is a general introduction of IC system, including the concept of IC as well as discrimination between similar concepts; the nature of IC; the social background of IC system.The second chapter is about foreign legal system of IC, including the ideological context of the IC system; IC system in common law countries and civil law countries; international conventions about IC theory.ChapterⅢof the article analyzes the IC system in China and the way to improve the system. The chapter is divided into two parts, the first part, reviews the legal sources of IC, and an example of IC is implemented, the reality of the system at present moment. The second part is talking about issues and its improvements as follows:the standards of the Informed Obligation of the Doctors, obligation of emergency treatment of dying patients, the priority between the relatives of the patients, the contradiction between cognitive ability of patients and medical professionals.
