With the implementation of the Labor Contract Law of the People’s Republic of China and the Labor Dispute Mediation and Arbitration Law of the People’s Republic of China in 2008,labor disputes and personnel disputes continue to expand..With the rapid development of the entity construction of labor and personnel dispute arbitration institutions in China,the shortcomings of the labor and personnel dispute arbitration system which is not suitable for the social development have been exposed in the implementation process of Zhengzhou.This paper studies the problems and reasons in the implementation of the labor and personnel dispute arbitration system in Zhengzhou from the perspective of the establishment and operation of the labor and personnel dispute arbitration institutions in Zhengzhou,and discusses the measures and suggestions in the implementation of the arbitration system,so as to make the system run more adapted to the new social environment,and thus give more effective play to the labor and personnel dispute arbitration.The role of stabilizing labor and personnel relations.The article consists of four parts: The first part is the introduction,which is used to introduce the research background and significance of the labor and personnel dispute arbitration system,to explore the domestic and foreign scholars’ research on the mode of handling labor and personnel disputes,and to elaborate the research ideas and theoretical tools.The second part elaborates the relevant concepts of labor and personnel dispute arbitration,and introduces the operation of the current system of labor and personnel dispute arbitration in Zhengzhou from the aspects of development scale and institution setting through data statistics.The third part of the article analyses the actuality and effect of the current arbitration system of labor and personnel disputes in Zhengzhou,and explores the existing problems of the arbitration system: the authority of arbitration institutions is not guaranteed,the arbitration of labor and personnel disputes is disconnected from the trial,the lack of effective supervision means,the lack of arbitration personnel allocation,and the quality needs to be improved.Four kinds of defects and their causes.In the fourthpart of the article,by investigating the foreign arbitration system and analyzing the implementation of the domestic advanced urban arbitration system,combining with the objective factors affecting the performance of the functions of Zhengzhou Labor and Personnel Dispute Arbitration Institution,the author puts forward some countermeasures to improve the system of Zhengzhou Labor and Personnel Dispute Arbitration from the practical operation level,including drawing lessons from the domestic ones.There are five aspects: foreign advanced practices,improving the mechanism of cooperation between arbitration and other departments,establishing the mechanism of connection between adjudication and adjudication,optimizing the establishment of arbitration institutions,strengthening the cooperative governance and implementing the tripartite principle. |
