On The Crime Of Obstruction Of Public Service, And To Impair People's Police In Public Security Of Organs Perform Their Duties On The Criminal Law Regulation

Policemen have being encountered more and more obstacles in the process of their duties in recent years. Ways of obstruction are from insult, abuse to violence, coercion. This phenomenon is not only the public security agencies to fight crime, maintain social stability by the functions impact, and the legitimate rights of police officers has caused great damage. The reason for the crime of criminal law and obstruction of official duties act of obstruction of police regulation is not complete, is an important reason.In this paper, the author analyze China's current situation of regulation to the crime of interference with public function. This based on the concept of crimes of crimes of obstruction of official business and the basic form of crime. Through collecting cases of obstructing police to enforce duties and the results of dealing with in D city, the author analyze the existing legislation problem on protecting, pointing out that the existing criminal law in the legislation on the protection of policemen from performing their duties behavior problems, and in judicial practice of obstruction in the duties of policemen found in the nature of behavior, the specific penalty problems. Finally, the combination of foreign and Taiwan region of obstruction of official crime, the police special protection law, combined with China's reality, made perfect advices for obstruction of duties of policemen in criminal acts of the legislative, judicial recommendations.
