On The System And Its Improvement Of Service Invention

Innovation is the necessary condition for a country to stand among the nations in the world, only to stimulate innovation, the nation-state can win its survival and development in the complex and intense international competition .since the implementation of the patent law and the implementing regulations of the paetent law of the people's republic of China and other regulations in 1980s,china has been building in the patent system for the discussion and practice, and also has made some achievements in theoretical research, legislation and policy development and improvement, but there are still many issues to be thorough and complete, like service invention. it can be said invention to improve and refine the patent system has become in the future scientific and technological progress, economic developments a key issue.Purposes of this article is to figure out how to further improve the legal system, enterprises and institutions to strengthen our patent advantages, enhance the level of patents enterprises and our competitiveness on the base of describing the historical origins and conceptual characteristics of service invention with reference to the legislative experience of foreign countries along with domestic research and comprehensive legal practice, the "Patent Law" and its implementation rules as the core of service invention.
