Research On Reward System Of Service Invention

At present, the world economy development is transformed into knowledge innovation-oriented model rapidly, intellectual property is increasingly becoming the main driving force of economic growth in the world’s major innovative countries, invention capabilities whose core is scientific and technological innovation, and intellectual property management capabilities are increasingly becoming key factors in the decision of the country’s economic growth potential and competitiveness. The strength of the service invention has been able to become the embodiment of the invention and innovation capacity of a country lies in service invention system can balance the enterprise and the staff, can optimize the allocation of resources of social intelligence. Not in an overnight can service invention system be completed, on the current legislation situation, it involves two steps:the first step is clarifying property rights legitimately, laws must be made to establish the difference between service invention and non-service invention, focusing on name service invention. The second step is to reward service invention, to protect intellectual achievements of the inventor and to encourage them.This article first introduced the special status of the reward in the patent system, to get well prepare for the service invention awards legislation. The birth of the patent system can be trace back to a special award of an incentive, the reward has always been an integral part of an important part of the patent legislation in the subsequent development. The service invention legislation, the reward is one of the two core content legislation. Then seeing the purpose of intellectual property legislation, the means as well as de jure, the service invention incentive legislation is necessary and reasonable, and of theoretical roots. After the theoretical arguments, this article will introduce the service invention in China, compared to the concrete well-practice of the service invention countries, such as the United States, Japan, and Germany, to provide some practical and theoretical basis for our service invention legislation.Finally, the combination of the above arguments and legal materials can give us some suggestions for our perfecting service invention reward legislation. Specifically speaking, our service invention award vested in intellectual property areas, so it has a double-attribute of property and personality. Therefore, on researching service invention, we should combine the characteristics of personal rights to analysis its characteristic, construction and rewards program. Finally, combining with the specific content of the service invention Bill (draft) issued in2012, I will provide some non-mature opinion for perfecting our service invention reward system.
