Recent years with the growing numbers of the property management companies, the disputes between the companies and owners are increasing, which involves the security obligations, it is quite obvious at present. In China we have some problems about our service on security obligations in theory and practice, the academic community's viewpoints of whether the companies are responsible to the owners on the safety and security are controversial. Existing laws and regulations are too broad and lacking of clarity, the judgments are often quite different, there is no unified judicial practice. Based on this, through the analysis of residential property services, safety and security obligations of content and standards, the author puts forward that the safeguards obligations is a legal obligation which based on the presumption fault as the doctrine of responsibility. From the< Tort Law> and other related systems, the author gives suggestions to improve the safety and security obligations in two aspects. The author hopes this article can serve judicial practice and provide effective legal basis and truly resolve the security issues of property service.
