| Property management in China is still an emerging industry, so the corresponding legal system is not integrity. There are many issues on subjects of civil legal relationship of residential property management, such as, the imperfect concept of the owners, the lack of legal position of owner groups, the unknown legal status of convention and committee of owners, and the nonstandard operation. The subject of civil legal relationship is infrastructure of civil legal relationship of residential property management.This paper includes preface, main text and epilogue. The main text is divided into four chapters.The preface is to clarify the significance of subject of civil legal relationship of residential property management, and show the main scope of the paper that is residential areas.The first chapter clears concept of subject of civil legal relationship of residential property management, and point outs that definition of property management in the Item of Property Management is too narrow. Moreover, the current names of subject of civil legal relationship in property management are not uniform, and the legal status of the subject is not clear. Some subjects are included in relevant regulations and laws, and others are easy to be misunderstood by people and corporations. The part analyses types and characteristics of the subjects, which builds foundation of the below content.The second chapter emphasizes the concept of the property owner. The part disagrees with the point of view that suggests construction units and non-owner-using person as the property owners. Furthermore, the paper classifies the property owners and analyses the rights and ability of the property owners.The third chapter focuses on reasons that regulate the owner groups. It is necessary to analyze establishment, change and termination of the owner groups. This part also analyzes the current problems existing the owner groups. Meanwhile, it is essential to set up supervisory agency for the committee of owners and property service provider.The fourth chapter explains that a property management corporation is a service provider but not a manager, and further suggests the scope of property serving provider should include not only property management corporation but also the non-corporation and individuals who have capital and capability to carry out property management. |
