| Since last century, with the broadcast, the television, and the development of press, various kinds of medias information, there must be some inauthentic and subjective reports may injured human dignity and privacy. Due to the ambiguous recognition of the relationship between press freedom and reputation protection, it's difficult to try cases in judicial practice.In fast few years, the news tort cases'give four characteristics: a, honorary tort take a most amount of news tort case; b, news media losing a lawsuit is high; c, spiritual damages judgment is more popular used than apologizing; d, tort reason is reported fact not accurately. When news infringe honorary right is becoming the major part of news tort case, the news administration of justice is in awkward condition. We are almost can not find the legal regulation except a few regulations about citizens'criticism right. Though the honorary right legislation is more systematization, our news legislation can not cover actual life and new condition. Legislations don't settle causes news and honorary right conflict. |
