The Research On Procedures Of System Of Administrative Assistant

The administrative assistance under modern administrative idea pays more attention to the guarantee of human rights and the serving means in the course of exercising powers. However, our country has not the unified and perfected administrative assistance system yet. The relevant regulation of the administrative assistance appears in the relevant laws and regulations and the regulatory files. There arc some shortcomings of China's administrative assistant such as a theoretical concept has not completely sorted out, the practice is still rather chaotic, the legal provisions are less than perfect. Therefore, it is necessary to conduct the assistant for further research to explore, aiming at the attention from theory to practice and being extensive and in-depth researched and effective application.This paper consists of three parts:the introduction, body, the conclusion. The introduction is part of the first chapter, largely on the background and significance of research, literature review, research methods and innovation; the conclusions is part of ChapterⅦ, pointing out the content and limitations of the paper, emphasizing the requirement of the further studies of the administrative assistance to turn the assistance into law and to establish procedures of system of administrative assistant; the body is a major part of the article,Ⅱ,Ⅲ,Ⅳ,Ⅴ,Ⅵ.ChapterⅡis the basic theory of the administrative assistant. The author analyzes of the definition of the concept, the nature, function and the legal relationship of the administrative assistant among the academic community.ChapterⅢis the thinking on the theoretical and legal base of the administrative assistant. The author analyzes the theoretical and legal base for the existing of the administrative assistant from the following four views:Chinese traditional culture, constitutional law and administrative law.ChapterⅣis the development and assessment of the administrative assistant system in our country. In this chapter, the author introduces the status of development of China's administrative assistant, sums up the main problems existing and analyzes the cause on the basis of it.ChapterⅤis the Practice of foreign administrative assistant and the Enlightenment to China. This chapter introduces assistant for the foreign-related practices and studies from their advanced experience in USA,England and Japan.ChapterⅥis the specific recommendations of establish procedures of system of administrative assistant. It is not only the focus of the article but also innovative chapters. The author puts forward a constructive approach for improving China's administrative system of assistant from the following five aspects:legislation, monitoring, procedures of assistant and relief.In short, the paper that goes at the basis existed, through further profound and systematic study to combine reality endeavors to contribute for the construction of the procedures system of administrative assistant.
