Nowadays, Internet Technology has permeated every corner of the society. In any country ruled by law, every citizen plays two kinds of roles. With the help of Internet, people are able to exchange information, and even governments could perform their function in a better way. But we must notice that Internet is a double-edged sword. While bringing convenience to our life, it also contributes to the violation of citizens'network privacy, which has seen a trend of escalation. However, in our country, current law in this field has lagging far behind actual demand. Except in tort law, there is no rule concerning privacy protection. Mutual quotes and interpretation in department laws can never meet the need for protection. Therefore, how to evaluate network privacy protection from the perspective of the Constitution has become a difficult issue. There is little research in the field; I want to attempt to do something, hoping play a function. Related research is relatively small, so this article does attempt, hoping to play a catalyst role. First of all, this article reviews the concept of privacy, privacy of proposed, analyzed the nature of the right to privacy, elaborated on the characteristics of the network privacy, pointed out that the importance of protecting the citizens'network privacy in the Internet age. Second, analysis of theoretical foundation of network privacy right of citizens, thus stripping the citizens network privacy cloak of civil law, rise to constitutional civil network privacy level to its protected mode. Then it takes USA and German as typical examples to find solutions that suits our national conditions, namely, indirect constitution indirect protection. Then make the protection a primary time, after the first. At last, it provides some non-institutionalized suggestions towards countering the phenomena of online privacy violation happened today.
