Research On The Legislation Of Morals Under The Socialist Market Economy

Since the reform and opening up, the Chinese characteristically socialistic ideology of rule by law is the combination of the basic legal principle theory in Marxism with the concrete practice of nomocracy in China, which is enriched and developed continuously by CPC in practice, and also shows the important achievement of localization of the legal theory of Marxism. By doing this, the ideology of Marxism is becoming to the realistically theoretic foundation of Socialistical nomocracy, which is enriched and developed greatly. Therefore, to do some researches on this issue not only have profound theoretic significance, but also have important value for Practice.This paper, which mainly have introduced Deng Xiaoping's democratic legislative ideology, Jiang Zemin's cerebration of governing the country by law from "the three Represents ideology" and Hu Jintao's legislative concept of rule of law from "the Scientific Outlook on Development ideology", all of these are important components of Chinese characteristically Socialistic concept of nomocracy. Generally speaking, Den Xiaoping's democratic legislative ideology is the beginning of Socialistic concept of rule by law in China, which constitutes an important theoretic basis for the ideal of nomocracy, and then Jiang Zemin, the past chairman of China, who had inherited and developed Deng Xiaoping's democratic legislative thought and proposed the strategy of governing the country by law, its significance is similar to the milestone in the way of Chinese legislation progress. When we stepping into the new century, the CPC central committee, whose general secretary is Hu Jintao, based on the basis of summing up the experience and exhortation of Chinese socialistic legislation construction and learning from the human civilized achievements of the rule by law, start from the perspective of the overall situation of Chinese characteristic socialism and take the guideline of "the Scientific Outlook on Development", have raised series of ideology of nomocracy. At the end of this paper, the author has given some discussion on the revelation that the Chinese characteristic socialistic ideology of nomocracy bring to us, which is of important significance and far-reaching influence.
