The Formation, Development And Enlightenment Of Western Rule Of Law Culture

Throughout the process of the rule of law in China,every stage has its origin in certain social and economic conditions.Contemporary China is experiencing a historical change and a great transformation from traditional society to modern society,and the reform and opening up has entered a crucial stage.At this moment,in the fourth Plenary Session of the 18 th CPC Central Committee adopted the "decision" of the CPC Central Committee on several major issues comprehensively promote the rule of law that the law construction of our country in the new period and new situation,also need to continue to strengthen the construction of the rule of law.The law as a local knowledge,just by transplanting the advanced laws of the west,in order to achieve the advanced level of the rule of law is not enough,behind it must have the support of the legal culture of the Chinese characteristics of the soil.Although the rule of law culture from western culture or ethnic characteristics,but the identity,therefore,the culture of the rule of law is bound with local and national characteristics.To build socialist legal culture Chinese characteristics,must make the rule of law culture in the context of Chinese growth,in addition to the outstanding achievements of the inheritance and development of Western civilization,it must be on the basis of the survey China special national conditions and local resources,so this paper research ideas on removal of introduction and conclusion is divided into four parts:The first part is mainly about the origin of Western rule of law and rule of law culture content that explore the western legal culture,based on Aristotle’s thought of good law and good governance as the starting point,formed the thought of natural law as the cornerstone of the rational spirit as the rule of law,justice as the highest principle,and the rights for the content of the main components with the development of western legal culture characteristics.The second part is mainly on the west to develop this law culture to explore from the basis of economic,political and cultural traditions and social development,the West as the birthplace of the culture of the rule of law,its development experience which is worthy of reference to the construction of socialist modern culture of rule of law in our country,which must be discarded.The third part,through the comparison of the main content of Chinese traditional legal culture and western legal culture,obtains the most distinctive feature of Western rule of law culture.To pave the way for the final western legal culture enlightenment,in the fourth chapter,the first analysis of western legal culture of China’s reference,the conclusion that the development mode of China’s socialist construction with the culture of the rule of law,which should be based on the market economy and the rule of law government as the leader,with the socialist core values to lead and as the construction of the rule of law culture of the soul,finally in people’s legal symbol,ritual,sacred,and legal education,so as to form the legal faith in the people.At the same time,the above four points will be consolidated and pushed forward at the same time,and eventually we will build a socialist legal culture with Chinese characteristics.
