This paper starts with the debate on the academic circle with regard to the concept of minority, illustrates the necessity and feasibility of the minority rights protection under the Democracy. Standing the height of the Constitution, Democratic system as a starting point, gives attempt to the protection of minorities. Minority as a single individual, should enjoy basic human rights, pushing Democratic away, minority is the ordinary people in the social life, should enjoy the rights of constitution and laws conferred to citizens, and fulfill the obligations of citizens. With the establishment of Democracy, settlement of disputes and processing matter can be relative fair and efficient. But from a legal point of view, nobody can no limit deprive basic human rights of minorities, although put on the cloak of seemingly legitimate, is also belong to"the tyranny of the majority", and is the drawback of modern Democratic. Therefore, this paper further illustrates the special protection for minorities; this form of inequality is order to pursuit the substantive equality. Learning form history, it is necessary to protection of minorities, giving the protection to minority does not violate equal and no new round of discrimination; this is precisely reflection of the essence of modern Democracy, is also the requirement to achieve substantive equality...
