Complaint Letters And Visits Causes And Legal Regulation

In recent years, the letters and visits involving litigation developed dramatically and became increasingly serious. In the practice of trial, it bears both legal and practical characteristics and is obviously different from the counterpart system in foreign country. The research on and analysis of the causes of the letters and visits is very important for the precaution of it. Considering the history and status quo of China's letters and visits system, the causes may be summarized as four levels: 1. systematic problem; 2. social problem; 3. court management; and 4. psycho factors of the parties. Undoubtedly, the problems of the letters and visits shall exist in a relatively long time. However, it is an urgent task for the people's court to face, recognize and deal with it. A good solution of it reflects the judicial ability of the people's court and the judicial guard for the development of rule of law. It is a comprehensive and systematic project to solve the problems of the letters and visits, which needs efforts both from the people's court and society, and thus requires an overall treatment from legal level, court system, social level, and the like.
