Our Country Collective Construction Land Use Rights Transfer Regulation

Land for collclective use (hereinafter referred to as land) in rural country in China have long been heavily carrying the burden of the life and production of people who resides there. China government, for purpose of protecting the interest of resident people in rural area, and of preventing from the lost of farming land, has established the law and regulation restricting the transfer of collective-owned land. the right in use of collective-owned land had also been limited in the collective group. it had caused the transfer of the right in collective-owned constructive land had moved against the regulation, land mentioned had to go privately into the market, where had hidden a great number of use right transfer of collective-owned land, which led to market disruption. following up with step of the market economic development and urbanization development, use right transfer in collective-owned land had gradually been grown from privately to scale operation. the thesis is focusing on giving a specific theory and analysis for the use right of the land and forming the proposal of use right transfer of land.The thesis consists of four chapters, of which chapter one quotes a case which is about painting named liyulan in beijing purchasing the property of the collective-owned land. it reflected the legal omission of sale prohibited for privately development of land by the case. it also come up with the purport and study method. chapter two gives a specific theory analysis of the land transfer by using relative concept. chapter three gives a case analysis of land transfer, in order to further discuss the defects of the land transfer system and look forward the trends of land use right transfer. it also briefs the transformation status of land use right by using the testing result achieved in guangzhou and chengdu city in china. chapter four will make up for the idea of land use right transter, and propose legally for the transformation on the system.
