The developments of the Digital technology have made many significant impacts, while the computer games, as an important part of the human society, are transforming into the section of online games. The online games have become an emerging industry, however, the current legal system is unsatisfactory. The online games have obvious features of the Digital technology. For this reason, by using the copyright law, the actual problems are faced, that it is hard to classify them. Based on these considerations and awareness, this paper aims to analyze and demonstrate through the application of comparison, historical methods and analysis of cases. This paper, which is divided into six chapters, is unfolded by a simple preface.The development of online games is reviewed briefly in chapter I. The degrees of playability and fun are the vitality of online games. In general, the online games are formed by the name of game, the plot of game, the modeling of the characters, the painting works, the data of games, the program of games and the text of games.Chapter II introducted the forms of online games infringement and legal protection, analysised the main forms of online games infringement like Piracy, PW, and plug-in. Compared the pros and cons of the protection by trademark, trade secret law to protect, patent law, copyright law and copyright law. Concluded that the most practical approach is to adhere to copyright law as the basic.The position of the copyright for the online games is discussed in chapter III, especially on the differences and similarities between it and the works of computers, movies and multimedia works. It is considered that online games should be divided into the works of movies by now, it might be a part of works of multimedia when appreciate in the future, or protected as a single section.The scopes of protection and rules of infringement are investigated in chapter IV. It is considered that the programs and plots of games should be protected separately, which form the online games, in order to make them protected comprehensively. It also introduced methods of how to judge the infringement of online games.The restrictions in Online Game Copyright Protection, like rational use, protection period, the statutory license and compulsory licensing are discussed in chapter V. It is considered that these constraints should be more practical.This paper is summarized in chapter VI, the law protection to the copyright of online games are prospected. It is put forward that the protection to copyright must be adhered as a basis, other law protection should be combined at the same time. The copyright law is supposed to be revised timely, and the exclusive laws, when it is necessary, must be legislated.
