With the development of China's Internet infrastructure and improvement of the Internet economy has been developed rapidly,but some Problems are gradually exposed.Network game,as with the development of the Internet economy in emerging products,throughout the year,Our country has developed for nearly twenty years,and obtained the certain achievement.According to the latest statistics from the general administration of press and publication,about a third of China's 120 million Internet users are online game users.In 2006,the online game industry in mainland China has exceeded 5 billion yuan,and the online game industry has become one of the important driving forces for economic development.The steady and rapid development of online games is inseparable from the protection of intellectual property rights of online games.Traditional trademark,copyright and even patent system exist and apply in the world of online game,and become more complex,and the voice of legislation for online game is getting louder and louder.Therefore,to establish the intellectual property protection system of online games,it is necessary to understand the special nature of infringement forms and protection of online game intellectual property rights.With the expansion of the scale of online game industry in China,there are more and more legal disputes in the field of online games,including a large number of copyright infringement disputes of online games.Such as "hanging","private" and "virtual property".At present,the legal research on online games is mainly focused on these problems.At the same time,the emergence of these problems is that although network game in essence is a kind of software,but the network game has its own characteristics,simple online games as the general software for protection is not satisfactory,form a complete set of legal protection,however,is still poor.Therefore,it is urgent to improve the relevant legal protection measures for online games in China.The author inspired by the case —the "three kingdoms" vs "the three countries to cut",which caused the copyright protection of network game alone to carry on the protection of the corresponding research,in order to help the healthy development of China's online game industry.This paper is divided into five parts.The first part introduces the basic knowledge of online games,such as the definition,classification and operation principle of online games.And the necessity of protecting network game copyright is analyzed.In the second part,the author adopts the case of "three kingdoms killing",which is suspected of infringing on the copyright of online games,and introduces the thinking on the mode of online game copyright protection.This part mainly introduces some basic cases of the cases involved in this paper,and discusses and analyzes the focus of the dispute between the two parties in the case.Then,through the analysis of article 3 of China's copyright law,it is believed that the game of "three kingdoms killing" belongs to the type of works protected by China's copyright law.In the third part,the author discusses the infringement of copyright in the murder of The Three Kingdoms by using the principle of dichotomy of thought and expression and the judgment of "contact and substance similarity".In the fourth part,the author analyzes the current situation and existing problems of online game copyright protection in China.Fifth part through to the foreign countries to protect network game perfect network game copyright protection mode analysis,from different angles to our country network game of copyright protection is put forward a little advice,in order to promote the network game of copyright protection in China to provide some help.The last part of the conclusion is a summary of the full text.This paper discusses about our network from a theoretical point of view.Games of some problems of copyright protection,think network game can consult film works protected by the copyright law of the network,in order to promote the healthy development of the network game industry.The last part is a summary of these ideas and insights.
