Report Of Juvenile Justice Practices Ofarea D In Gansu Province

Juvenile delinquency is a current social problem, whose social harm is extremely serious. To prevent and treat juvenile delinquency is an important responsibility for the whole society. Juvenile justice system is designed for juvenile criminality and the establishment of a special judicial system. Compared with the adult justice system, it shows more manifestation of the protection of juvenile offenders and educational philosophy. In China juvenile justice system started very late and now only in a few large cities a more robust system of juvenile justice system have been formed. Most national judicial practice does not strictly distinguish between the cases of juvenile delinquency and adult criminal cases in the specific the difference between the application of the judicial system. In the D area the total population of Gansu Province is 58 million, of which about 11.3 million are minors. According to statistical analysis, D, juvenile delinquency over the past decade has shown a rise in crime year by year. It continued to increase in the extreme cases of malignancy and juvenile offenders are becoming increasingly younger and so on. Minors face an increasing crime rate, so D the current juvenile justice practice areas appear to be backward situation unbearable That can not effectively curb the trend of juvenile delinquency. This situation is not conducive to the safety of society and the youth's growth. Based on the statisttical analysis of juvenile delinquency over the past decade and the judicial practice of the juvenile delinquency cases in D area, this essay studies the phenomenon of juvenile delinquency during the sampling , interviews, statistics, analysis, including the change of number of juvenile crime, juvenile crime type, juvenile offender's age, educational level, identity and the practice of the judicial system in D area, etc. Through comparison with H area of Shanghai, juvenile justice practice is more comprehensive study of the D, the practice of the juvenile justice system and the reasons for the problems, issues: First, the relevant juvenile justice system is not complete ;Second,two specialized agencies of juvenile justice is not perfect; Third,judicial treatment measures is not efficient and there is no community corrections. It has three reasons. First, the judicial resources are not adequate. Second it lacks high-quality professional judicial staff. Third ,community corrections system is not perfect. Based on the characteristics of juvenile delinquency the hardware of judicial status in D area, the author puts forward several measures to improve the juvenile justice practice in D area according to the above analysis and investigation. These measures include improving the juvenile justice system , improving the organization and equipment of the juvenile justice system and speeding up the establishment of community corrections system.
