The Research On Relationship Between Government And Charitable Organization In The Transition Period

Since the reform and opening up, our country's economy has a rapid development, the people's living standards are generally improved. But at the same time, the gap between rich and poor expands gradually, social contradictions are more and more outstanding. The government may encounter "Do Not-Work" condition inevitably when dealing with these problems, but charitable organization can utilize resources that are out of government to meet the social needs, to lighten the burden of government, and they can cooperate with the government to deal with the problems. In short, charitable organizations play an important role in safeguarding social fairness, protecting human rights, promoting social progress and harmonious development. Therefore, it is necessary to build and develop charitable organizations, government and the public must give support to them.In the transition period, one change of our government's functions is that paying more attention from political domination to social management functions. So our government has a positive and supportive attitude towards charitable organization, and to a great extent, the government play a lead role on the development of charitable organization. There are two main reasons:Firstly, since ancient times, our country has the tradition of "the government is a whole" and "the government charity"; Secondly, in the transition period, the conditions of charitable organization's existence and development are very lack, there exist many problems as follows:the imperfection of laws and regulations, the imperfection of tax incentive policy, the absence of supervision mechanism, the lack of evaluation and feedback mechanisms, the absence of self-discipline mechanism and so on. All these problems can only be solved and improved under the leading role of the government.Thus, in the transition period, the relationship between government and charitable organization is Leading and Cooperative in our country. By analyzing this relationship in-depth, it can not only provide references for the study on the relationship between the government and charitable organization, but also have the important meaning in carrying forward our country's charitable culture, improving the degree of concern on charitable cause, realizing the harmonious development of the whole society.In this paper, Firstly, the author introduce the basic concepts of the social transformation, charity, charitable organization and the general situation of our country's charity organization's development; Secondly, by the typology theory of relationship between foreign government and charity organization, and combined with the problems that our government and charitable organization exist in the transition period, author analyse in-depth the government's leading role and the charity organization's cooperative role.On the analysis of existing problems between government and charitable organization in the transition period, this paper shows five main problems:the lack of laws and regulations leads to few quantity of charitable organization, the imperfection of tax incentive policy leads to the shortage of the power in the charitable organization's fundraising sources, the absence of the government's supervision leads to the low credibility of charitable organization, the lack of evaluation and feedback mechanism leads to poor ability in fundraising of charitable organization, the lack of Self-discipline mechanism leads to backward in charitable organization's own construction. According to these five problems, author put forward the system arrangement for the government and charitable organization respectively-----the government's aspect:give charitable organization legal status, formulate tax incentive policy of charitable donations, set up the whole society's supervision mechanism on the charity organization that under the government's lead, establish a credit rating system, construct our country's characteristic charity culture, these are the government's leading role; charity organization's aspect:strengthen the construction of charitable volunteer team, establish cultivation mechanism of the charitable consciousness, strengthen the construction of credibility, establish an effective donation mechanism, establish the reasonable talent mechanism, these are the charity organization's cooperative role. In the end, the disaster relief and rescue in Wen Chun as an example is to specify this relationship,In the process of analysis, author referenced a lot of relevant information, but also have author's own innovation as follows:at present, in our country, there are so many research of relationship between government and charity organization, and the most study is on the interactive and cooperative equal relationship, but, according to the charitable tradition of our country and the special conditions in the transition period, author expressed a view that the relationship between government and charity organization should be leading and cooperative, and this relationship will always exist in a certain period. On the other hand, due to the author's limited level, there also have a deficiency:in analyzing the system arrangement, there are only five aspects of government and charitable organization respectively, it can not be able to summarize and explain the government's leading role and charitable organization's cooperative role completely. It needs further research and discussion.
