On The Government Supervision Of Charitable Organization In China

Charity is vividly called a supplement to the social security system.It plays a crucial role in narrowing the gap between rich and poor,promoting social fairness,and improving the social security system.It is the " third distribution" of social income.Although our country's charity started late,its development is very rapid.Since the reform and opening up,the number of charitable organizations and the total amount of charitable donations are very considerable.The state has continuously increased its emphasis on charity and gradually incorporated charity into social security.It hopes that charity can share some of the government's functions,especially in poverty alleviation and relief work,and contribute to accurate poverty alleviation.As a result,corresponding adjustments have been made in legislation and supervision.This article mainly studies the supervision of charitable organizations by the government of our country.Although there are many subjects of supervision of charitable organizations,charitable undertakings have been formally incorporated into the scope of government supervision according to law with the promulgation of the charity law of the people's Republic of China.Therefore,it is of more profound significance to study the supervision of charitable organizations by the government in the fields of public policies and public affairs management.This paper reviews relevant research literature at home and abroad to learn from previous achievements.It clarifies the thinking of this research,defines the relevant concepts of charitable organizations and government supervision,takes the theory of voluntary failure.The theory of public responsibility and the theory of principal-agent as the theoretical basis for government supervision of charitable organizations.It demonstrates the necessity of strengthen government supervision of charitable organizations,and adopts the methods of literature analysis,induction and summary,and comprehensive analysis to carry out research.This paper finds out the problems existing in the supervision of charitable organizations by analyzing the current situation of our government,including the main body of supervision.The current legislative situation and the current supervision situation.the main problems are the unclear power of the government supervision department,the weak operability of the supervision system,the limited supervision effect,and the lagging of the internal and external supervision ideas.it also puts forward corresponding solutions to these problems,which are respectively to reposition the relationship between the government and charitable organizations and to perfect the government supervision system of charitable organizations.Through these two paths,the government will establish the thinking of supporting and guiding charitable organizations,and fill up the supervision system of charitable organizations through diversified supervision methods.Allowing the government supervision to command and other supervision methods to carry out their respective duties.The innovation of this article is to firmly grasp the characteristics of the times,based on the study of the " charity law of the people's Republic of China" promulgated in 2016,to consult a large number of the latest materials,and to keep pace with the times in the research of charitable organizations and government supervision.With a view to making some contributions to the existing research on government supervision of charitable organizations.Of course,this article also has some shortcomings such as the lack of professional interpretation of relevant legislation in the field of charity,and hopes to gradually improve in the future study and research.
