The Expansion Of Enterprises Labor And Social Security Credit System

The enterprises labor and social security credit system ("the System"), which evolves with the construction of overall social credit system and the development of the labor inspection, is designed to enhance firms'credit level in the area of labor and social security. According to "the Guiding Opinions of the Ministry of Labor and Social Security on Promoting the Enterprises Labor and Social Security Credit System", the System is merely a credit evaluation, rating and supervision system regarding labor and social security. The System has many flaws, and it fails to play its designed role. After looking into the theory and reality basis for the expansion possibility of the System, and considering the practicing conditions, this paper suggests some views and ideas on the expansion of the System.The first chapter is an overview of the System. By introducing the definition, the history, the structure and the implementation of the System, this chapter is trying to provide a basis for further analysis on the necessity of the expansion of the System.The second chapter discusses various flaws of the existing System from different aspects, such as supporting sub-systems, information sources, evaluation mechanism, incentive and punishment mechanisms, to prepare expansion of the System. The third chapter studies the necessity and feasibility of the expansion of the System. By studying the government's responsibilities in labor relations, the operation of the System, and so on, this chapter provides theory basis for the expansion of the System. By introducing cost analysis on the labor dispute settlement, this chapter concludes that the judicatory cost is too high to insist integrity. The expansion of the System is designed to let the credit fully play its role in the market, while the government adopts certain macro control measures. In this way, it will lead to a mechanism, that the honest gains but violating rules is punished, so eventually the enterprises will be encouraged to be honest and abide by laws. By uploading the judgment papers onto internet and disclosing enforcement information, as well as constructing the social credit system and the local platform of enterprises credit, a realistic basis for the expansion of the System is ready. On the other hand, deposit system for migrant workers'wages is a successful mode of the expansion of the System in certain area regarding the rating and supervision mechanism and dishonesty punishment mechanism.The fourth chapter is the author's suggestion on the expansion of the System. It is suggested to improve legislation relating to the System, to establish a comprehensive information platform of the labor and social security credit of enterprise, to get information transparent and fully exploited, to establish a scientific credit evaluation mechanism and a effective incentive and punishment mechanism, so that the System may be expanded and promoted.
