Since the food industry emerged in food additives, we can enjoy a variety of food at any time and any place. When we enjoy the delicious food, we should also care about the nutrition, especially the food safety. But the frequent domestic and international food safety incidents scare us. To do the regulation of food additives have become a major livelihood issues that we must resolved. In this paper, we make Sanlu milk powder incident and other major food safety incidents as a starting point to analysis of the existing food additive regulation. Then we start from the problems to find which we can learn from the foreign legal approaches. Of course we should combine with China's special conditions to explore solutions. This idea is mainly coming from the food safety standards, food safety and food recall system certification system to describe the three aspects specifically. In other words, the regulation of food production should be in the former, production and post-production. So we can control the safety risks of food additives the three time periods.This paper is divided into five parts.The first part is about an overview of food additives, this section discusses the concept of food additives, types, and also describes the theoretical basis of the food additives and economics theory, and that the regulation of food additives of practical and theoretical significance.The second part is about the regulation of food additive status, this section discusses the legal development of China's food additive process in general terms, and to existing laws and regulations of food additives to make a more detailed description, followed by focusing on existing laws and regulations that exist enough to analyze.The third part illustrates the China's food additive regulation legal problems, food additives on the part of the first standard-setting procedures to make elaborate; followed by that of testing personnel, detection of missing skills assessment; Finally, the lack of legal responsibility, not only no legal responsibility requires the executive branch, there is no clearly defined corporate responsibility.The fourth section, you can learn from foreign legal systems, this section discusses the major developed countries in the food safety regulatory experience. Specifically addressing the United States and Japan's food safety regulatory model, a general introduction to the German and the European Union and other countries can provide a reference to our food safety regulatory model.The last part is mainly improving our response to food additive regulation, this section mainly for the third part presents the various legal issues, put forward some solutions corresponding countermeasures. Including how to improve the regulatory standards for food additives, food safety certification system for the establishment and how to improve and speed up the food recall system, the establishment of information disclosure system and establishment of regulatory supervision responsibilities.
