Civil Liability Of China's Food Recall System

Recent years, we sadly recognize that China's food is not safe after a lot of food safety accidents happened. These incidents not only reflect the company neglected their community responsibility but also reflect the food safety legal system is highly incomplete. "Food Safety Law" as a norm of national food safety laws, is considered to be the solution. And it is the first time established a food recall jurisprudence in the national law. So it is attractive lots interests. The same as in the Article 96 which provides punitive damages jurisprudence. This article in the "Food Safety Law" is an opportunity to discuss the "defects" food recall and compensation related issues. And the "Food Safety Law" raised the level of food recall system and the legal effect of the legislation. The recall system by analyzing the nature, I believe that the basis of the relationship is still adjusting the field of civil law. And breach the recall duty will cause private law tort liability which is different from general products tort liability. After discussing the food recall system we'd better continue with civil liabilities, especially about punitive damages.
