Light Punishment Of Crimes Committed In The Judgment Research Questions

In recent years, we often hear a word in the field of anti-corruption——"the duty crime". The duty crime means the national public official uses his position to implement crime. The duty crime is the most serious corruption, spoiling the social atmosphere, it destroys the party-mass relationship, abuses people’s property, it impacts the social contradictions and becoming the important factor that affects economic development and social harmony and stability. With the light of the punishment on the development’s tendency, the duty crime’s light punishment tendency is more and more obvious, after we analyze the data display, we find in court probation from the criminal punishment, the proportion of application of probation and exempt of punishment is too high. Now it is seriously affects the authority and the unity of criminal law, and reduce the cost of crime. This trend has caused the wide attention of the public, we want to handle the anti-corruption work, and we must solve the problem of light punishment on duty crime.This article has four parts. The first part is the introduction, it expounds the writing background, the writing purpose and meaning, it also writes the research reviewed. What is important is the first part defines concepts of the duty crime; the second part of the article analysis the harmfulness and characteristics, in order to find the essence characterizes, this part does the targeted analysis, at the same time, it leads to the theme.The third part is trying to find the cause of the problem of light punishment on duty crime:the first one is its own characteristics of duty crime, the second is the defects of the legislative level, the third one is the problem of enforcement law level, the fourth one is the discretion of the judge, the fifth is the issue of legal supervision mechanism.The fourth part is trying to find the countermeasures of solve the problem of light punishment on duty crime, from the cause of the third part to find corresponding countermeasures, which means based on the duty crime itself, we can find the method from the legislation, the judicial and the supervision mechanism.
