Thus, a scientific and an advanced business entity legal system can improve business activities, guaranty business continuity, and increase social productivity.Because of historic reasons, our country lacks a comprehensive business law system. The legislative system that we use now is a combination of civil and business laws. China's legal system of business entity has experienced from a planned economy to a market economy in five distinct periods, Looking at the structure of our business entity legal system, we find that redundancies, loopholes, controversies and conflicts exist in the legal boundary of each law towards all kinds of socialist, contracted and coorporated business entities.Our market economy is growing fast and it is urgent to be compatible with the world. The original business legislative system is no longer suitable to the need of our recent fast economic development. In order to meet that need and overcome the shortcomings in our legislative regulation, we need to perform deeper studies to the business legislative system. This will help us establish a mature ideal ist system and business method theory, form an advanced business legislative framework, and get ready for the potential development of our business legislative system.This thesis has done some research and studies on our current business entity system based on the deep analysis of our current business entity system and the advanced experience of foreign countries and from the point of developing our market economy and increasing the distribution efficiency of social resources. Put forward to want to perfect the Business entity legislation, clear the legislative status of business entity, Optimize the structure of the business entity legislative system, to establish the" company law" and" partnership enterprise law" as the basis for the modern Business entity system of legislation.
