Discussion On Concept And Practice Of Cyber Crime Investigation

This is an era of web2.0 when the Internet users are no longer receiving Internet information passively but actively creating Internet information. What's more, the great interactivity of this era is also unprecedented. The rapid expansion of information space does not only facilitate people, but also provides rich soil for breeding crime. These cyber crimes with technology are in multi performances, and with the technology continues developing into more subtle and unpredictable, it will bring criminal investigation more serious practical difficulties. It is necessary and also extremely urgent for current criminal investigation work to settle out how to jump out from the traditional investigation concepts and explore a new type of investigation concept and specific detecting practice for cyber crimes. Although the current academic research on cyber crime has also been given a lot of attention and reflection, however, most of them focus on the areas of criminal law and evidence science. Some researches may involve some investigation aspects, but it is mainly for emphasis on the relevant collection of electronic evidence or put forward ideas at the technical level; actually as for the investigation, the guidance is still lacked. The author of this paper works as a grassroots criminal investigator in the police office and tries to conduct a systematic exposition for related issues on cyber crimes from a detective point of view and closely combined with working practice. Except the introduction and conclusion, the paper is divided into four parts:The first part is an overview of cyber crimes. The paper first elaborates the Internet which is the carrier of cyber crimes, and briefly analyzes that the emerge of cyber crimes are inevitable because of the characteristics of the Internet technology and social features, and studies the typical crime forms of cyber crimes. On this basis, summarizes the definition of such kind of crimes and crime characteristics and constructs a platform for cyber criminal investigation.The second part is the current status of cyber criminal investigation and its difficulties. First, based on realizing the poor ability of cyber criminal investigation, points out that the present investigation concept and practice for such kind of crimes have lagged far behind the status of the crime development. Secondly, put forward the necessity and urgency for change of the current status.The third part is the conversion of thinking mode and construction of a new detection mechanism. This part is mainly about understanding the new situation and characteristics of cyber crimes, which need new means and methods to deal with, and consequently launches the discussion on the new mechanism's construction. From aspects of the institutional setting, the main qualities of detection, handling coordination, basic investigative work, and construction of technology development mechanisms, the author proposes to build a long-term effective and scientific investigation mechanism which is helpful for improving the detection capabilities.The fourth part is the discussion of expanding and perfecting the specific investigative measures of technical investigation based on learning from the traditional investigation ways and combined with work practice and technology development. First, discuss the scene investigation, survey interview, network tracking, web search, online waiting and other specific measures, and secondly, extract the investigation means for large-scale and complex website crimes.This paper applies research methods like comparative analysis and examples analysis to conduct a detailed exposition on cyber criminal investigations, and puts forward a number of ideas, although relatively shallow, the author hopes to offer a little help for the development and improvement Chinese cyber criminal investigations.
