Legal Research On Consumer Rights Protection In Internet Transaction

Internet transaction is a new means of exchange when the traditional transaction developing into internet times. The advantage of internet transaction lies in that it can bring consumers with faster and more convenient services. However, along with the development of internet transaction, some unharmonious notes unavoidably affect consumers' confidence to internet transactions and the development of internet transaction. Consumption is the drive of social and economic development. Consumers' confidences are the key to the health development of internet transactions. And perfect design of system can enhance consumers'confidences, reduce the risk of consumers and regulate the behaviors of the operators, and then protect legitimate interests of consumers.This paper takes the protection of consumers' rights and benefits in the internet transaction as the object of the study and adopts the logical thinking of finding, analyzing and solving problems. Firstly it specifically analyses the new problems concerning the protection of consumers' rights and benefits in the internet transaction and expounds how it is different from the traditional transaction mode. And then from the angle of legal system, it explores the reasons of these problems according to literature reading and problems found in the course of investigation. Finally, combining with the legislation and practice experiences of foreign countries, especially the related experiences of the United States and the European Union, it puts forwards the thinking of designing a system that not only acts on international convention but also matches with our national conditions from the three aspects of legislation, judicial and administration.Internet technology will make further development. The internet transaction will also continue to be prosperous based on the platform of internet technology. Facing our broad market, the potential of internet transaction is self-evident. Just because of this, a stable and perfect design of system is needed to find the developmental equilibrium point in the course of promoting the development of internet transaction and protecting consumers'rights and benefits. Of course, system design is just a certain part of protecting consumers'rights and benefits; it also needs the attention of the whole society, the professional self-discipline and active participation of consumers. However, there is no doubt that design of system must be given the priority. This is also the original intention of writing this paper.
