The Research Of Specific Regulations In Guangxi Autonomous Counties

Since the implementation of ethnic regional autonomy system, legislation of national autonomous areas has achieved better results. Compared with the comprehensive characteristics of self-governing ordinance, the specific regulations has flexible and specific characteristics, therefore, the formulation of specific regulations is a important and main way for implementing ethnic regional autonomy. This paper first solves the question of what the specific regulations is, analyzes the nature, the basis of legislation and the principle of legislation, then discusses the establishment of autonomous county in Guangxi, and the situation of formulating specific regulations. There are twelve autonomous counties in Guangxi, form since the 1990s, the autonomous counties in Guangxi had formulated seven pieces specific regulations successively. According to the national characteristics of autonomous county in Guangxi, these specific regulations work on the content of the laws, administrative regulations, local regulations, or fill in gaps of national legislation in advance, covering the management of forest resources, protection of wild plants, management of tourism, management of urban road and resettlement of immigration in hydropower station. The specific regulations and self-governing regulations are complementary in implementation, which have played a positive role in safeguarding and promoting, for strengthening national unity, promoting the development of economic and cultural and social progress in autonomous county. Meanwhile, this article conducts a text analysis to seven pieces specific regulations of Guangxi autonomous county, analyzes the value of the text, and if the terms have legislative value, reached the purpose of legislators. Then, this article points out the existing problems and analyzes why these problems arise. Only knowing these problems, can we grasp the essence of specific regulations; give full play to its function; promote the introduction of specific regulations better and faster. The final significance lies in more advantageous to promote the implementation of the system of regional ethnic autonomy, and solve the national problems.
