Analysis Of Criminalization On Phenomenons Of Ecological Crim

In criminology,the study on phenomenon of crime is equivalent to the study on crime.Therefore,the study on phenomenon of ecological crime is essentially the study on ecological crime.The ecological crime is a new type of crime, which appears with the rapid development of economy and society. The Industrial Revolution in the 18th century, greatly promoted the release of productive forces and the growth of material wealth, has caused serious pollution and destruction to the ecological environment. Due to the fact that ecological crime's tremendous harmfulness to human society received lots of attentions from people, related research on ecological crime gradually arose.Criminology and Criminal Law (narrow sense) both research on ecological crime. However, they have different objects of study. Criminology mainly takes ecological crime as an objective social phenomenon to undertake research;Criminal Law (narrow sense) mainly researches on the elements of establishing ecological crime. Therefore we must make clear the horizon of consideration when defining the concept of eco-crime instead of confusing the boundaries between different subjects. At the same time, these two subjects have some connections. Criminology provides foundation for criminal legislation through research on ecological crime phenomenon, playing the role of connection between subjects. From the nature of criminology, the concept--criminalization in criminology has its own characteristics, differing from the concept we usually understand.Having had a clear understanding of the connection between eco-crime in Criminology and in Criminal Law, a new definition was made on ecological crime from the perspective of criminology. And then from the fact level up to the legislative level, we choose a typical country's criminalization situation of ecological crime to make introduction, and then comment the criminalization situation in different countries. Based on the previous presentation, we had comparative analysis on current legislation and characteristics of ecological crime in our country, pointed out the shortage of our country's relevant legislation, and put forward proposal of legislation on ecological crime.
