As the deployment of funds,commercial banks plays a significant role in maintaining stable economic environment and promoting long-term economic development in modern economic life. In the context of economic globalization and the turbulent financial environment, the commercial banks are more and more aware of the importance of the practice of social responsibility, and gradually from the beginning of the individual consciously perform acts of social institutionalization of the industry-wide standardizationresponsibility for the activities ahead. There is a great monopoly in the business of China's commercial banks, especially the state-controlled commercial banks.They are closely linked with the healthy and orderly development of the national economy as a whole, which makes our commercial banks on the commitment to social responsibility, greater than any other general businessnecessity. Affected by the international development trend,China's commercial banks have in the social responsibility to achieve the initial stage, but overall, the social responsibility activities of commercial banks in China in terms of the understanding of the concept, system design or external norms are insufficient. File of this article based on our present national situation, look to the international advanced theoretical results and practical experience, trying to clarify the connotation of the social responsibility of the Commercial Bank Law to standardize legislation, regulatory bodies and industry organizations as a guide and supplement, combined with the commercial banks own socialresponsibility of management to urge the mechanism to build the institutional framework of the protection of China's commercial banks social responsibility activities. The focus is to define the meaning of the social responsibility of the commercial banks in the field of law, through the stakeholder theory to analyze the specific content of social responsibility in the commercial banks, as well as the lack of legislative and confusion, and try to suggest improvements.This article includes three parts of the introduction, body and conclusion. The text is divided into four chapters.The first chapter gives a basic theory for the full text.Introducing the concept of corporate social responsibility is mainly to clarify the concept of social responsibility from the perspective of jurisprudence, and extends to the social responsibility of the commercial banks. Analysis of commercial banks as the special status of the enterprises in the social and economic life to explain the content and features of the social responsibility of the commercial banks, and particularly describing the social responsibility of the commercial banks include the social responsibility of shareholders, customers, employees, communities and countries.The second chapter is introduced to the international community and abroad, the more universal commercial bank social responsibility to fulfill the criteria of the popular, below China's commercial banks social responsibility system constructed to provide a reference. Selecting a few typical countries and commercial banks to give a more specific introduction about the practice of these countries and banks.Chapter III focus at the status and shortcomings of achieveing social responsibility of China's commercial banks.It were analyzed from two aspects of the legislation and practice. Legislation is too scattered, messy, lack of overall coordination, operability is not strong.. The commercial banks'internal mechanisms are inadequate to fulfill the social responsibility initiative, limiting its role in the fulfillment of social responsibility.To undertake the issues raised in Chapter III, Chapter IV proposed a system to build the social responsibility of the commercial banks to achieve. Strengthen the legal system, improve the social responsibility of the commercial banks to achieve the external monitoring system and improve the internal control systems of commercial banks three more traditional levels of analysis and recommendations. Finally, the state-owned enterprises in China the nature of the social responsibility of the state-controlled Bank of China's national conditions.
