Since the early1900s the concept of corporate social responsibility was born,most enterprises have gradually given up mode of operation simply to make a profitoriented, begin to look more toward stakeholders. Corporate social responsibility cannot be ignored. Among the many stakeholders, environment is closely related toproduction and operations, utter devotion to human survival and development,So toassume more responsibility for the environment should become the realistic choice formany enterprises;Among the many companies, commercial banks as a specialcategory of market players, with huge capital reserves, can use financial means toexert influence on the production and operation of enterprises. Therefore, to explorethe commercial banks to practice social responsibility to the environment has a certainpossibility.This paper argues that, from the perspective of the legal point of view, thecommercial banks social responsibility to the environment should be divided intothree areas: First, the implementation of green credit; Second, active and innovativegreen financial products; Third, to cooperate with non-governmental organizations, toestablish a communication mechanism with the relevant subject. As a reference,China’s legislation and practice have imperfections. From the outside, there are a lotof legislative gaps, various notices, opinions, guidance system disorder, operability isnot strong, so it does not form a core responsibility of the legal system; Internally,China’s commercial banks have a number of issues in terms of corporate governance,green financial innovation means building an external communication channels, this isnot only the existence of the gap with the advanced approach to foreign commercialbanks, and can not assume social responsibility for the environment. Based on thisgap, we need to change.The entry into force "Kyoto Protocol",the birth of the "Equator Principles", theintroduction of the IFC social and environmental sustainability policies andperformance standards and advanced practices include Standard Chartered Bank,Citibank and HSBC, including the well-known international commercial banks forour legislators to legislate system design and environmental responsibility ofcommercial banks provide a useful reference. In terms of external sound legal system, I recommend focusing on the followingthree aspects. First, at the national legislative level, to make legal gaps, improve thebasic legislation, and gradually establish relevant legal system; Second, theeffectiveness levels of government legislative level, uniform regulatory standards,improve notification, advice, guidance and other normative documents and operability;third, optimize the domestic financial environment, and create a favorable legalenvironment for the gradual implementation of green credit policy. In terms ofimproving the internal management system, I will focus on the following threeaspects are discussed. First, the implementation of the "Equator Principles", improvecorporate governance structure and internal supervision and mechanisms; Second,accelerate financial innovation, improve product innovation for sustainable financialcapability; Third, establish environmental protection departments andnon-governmental organizations (NGOs) coordinated communication channels.
