Rural Land Circulation In The Role Of Government Research

Economic development demands for more and more land with further advance of the industrialization and urbanization. Rural Land Circulation plays not only a decisive role in national economic development, but also related to the vital interests of the broad masses of peasants and rural stability. Government plays an important role in the circulation of rural land. However, the local governments acted'overrun' and'absent'in rural land circulation. In order to protect the rural land circulating orderly according to law and ensure the food security of China as well as the long-term interests of landless peasants, we have to redefine the role of government in rural land circulation.So far, the research of rural land circulation mainly in the economic law, civil law, commercial law, agriculture economics, land management and so on. In this paper, the writer puts forward some new initiatives to redefine the roles of local government in rural land circulation, based on the analysis of the constitutional and administrative law.Dealing with the relationship between central and local governments: Firstly, constructs a legalization relationship of the central and local governments under the basic framework provided by the Constitution Law. Secondly, central government should absorb the local government into the policy decision-making process and respect the views of local governments according to the principle of arousing the enthusiasm of local governments fully. Thirdly, upholding and perfecting the comprehensive assessment criteria of government staff like morality, ability, diligent, achievements and honest to make sure the local governments transform from'investment-oriented'to'service-oriented'. Protecting18billion Chinese acre of farmland red line:constraints the government's administrative guidance in rural land circulation and improve the supervision mechanism of rural land circulation to make sure the behaviors of the governments are restricted by laws and the rural land circulate processes are restricted by the supervision from the higher level administrative authorities and public opinions. Social security of landless peasants:Firstly, needs the governments providing laws, regulations and policies. Secondly, requires the participation of landless peasants and express their own wishes fully. Thirdly, needs for the interactive consultations of governments, third parties and landless peasants to determine the specific location, size, compensation program, resettlement program of the rural land. Besides, the governments should advocate the enterprises assume more social responsibility in promoting the employment of landless peasants, protecting the rural ecological environment and the developing of rural public welfare.Hoping to improve legal system of rural land circulation, protect and implement the fundamental interests of the masses of peasants effectively, promote the sustainable development of rural areas through redefining the government roles of rural land circulation.
