According to the data survey from some relevant departments, China's total area of Houses withlimited property rights has reached6.6billion square meters by the end the first half of2007. Even thoughthe government has introduced some policies to strongly suppress the continuous increase of property price,the trend of increase in Houses with limited property rights becomes even severe. According to the currentsocial situation, I choose the topic of my research under the supervision of my instructor.Lots of social problems related to the Houses with limited property rights has been the focus of attentioncurrently. It reveals some of the problems of the existing land system, and the social systems. Researchesthat further investigate the property problems derived from Houses with limited property rights and problems,such as legal and land issue, behind the Houses with limited property rights has significant academic andsocial significance. After analyzing the historical reasons, revolution, and social background, how to regulatethe Houses with limited property rights, which meet the current social need but not tolerant by the law system,into a legalization way is crucial.Foreign countries also have ownership restriction, such as the charging system of public law level,nationalized system, adjacent to the level of private law relations system, space rights, right of firstrefusal. However, problems in the current topic are unique in the real estate systems, policies, and marketenvironment of our country. Derivative problems of the Houses with limited property rights exist over a longperiod of time, but it appears to have a tremendous impact on the city's real estate development and operationof market and bring concerns of the social contradictions and the people's governments at all levels andaspect of the society in the past decade. Therefore, theory and research data of Houses with limited propertyrights is not abundant. Due to the fact that the Houses with limited property rights relates to social survivalproblems that have social sensitivity and complexity, it is easy to contradict with the current land system andthe existing policy, To balance the interests of all participants is really difficult. Therefore, few legal researchexperts or senior legal practitioners completely investigate and report. Occasionally, a few researchersinvestigated the current problem of Houses with limited property rights, but it is not profound or systematic.The viewpoints are not clear and the methods are not applicable to the real problem. In other word, our current jurisprudence in face of the problems related to the Houses with limited property rights is basicallyblank over the past decade.
