According to an investigation, at the end of 2013, the total area of China’s houses with limited property rights has reached 70 million square meters. There are a huge number of small property exist over the country, in somewhere the proportion of houses with limited property rights occupies nearly 30%. In recent years, Our government has enacted policies to restrict the development of houses with limited property rights, but policies did not achieve its purpose, houses with limited property rights is still growing rapidly. Faced with such a large-scale houses with limited property rights, forcibly removed mustn’t be feasible, not only will causes a lot of waste of social resources, but will create a lot of homeless people which increasing the instability of our social environment and affect the harmonious development of our society. Therefore, the legalization of houses with limited property rights will be the best way out. After analyzing the current situation and the causes of houses with limited property rights, we can conclude that the plight of the legalization of houses with limited property rights is the existing legal system and the institutional land. However, whether reforming the existing land system, or modifying the relevant laws and policies will cause many adverse effects, and the process is too long, which is not conducive to solving the problem of houses with limited property rights immediately. Houses with limited property rights involves a wide range of interests, such as government, collective economic organizations or buyers, who are all hoping to be able to do not harm their own interests at the same time legalizing houses with limited property rights.In this regard, under the existing laws and the institutional land, from the angle of shared-property housing system balancing the interests of all parties, the paper classifies and discusses the specific embodiments of legalizing houses with limited property rights, also gives the way of measuring the proportion of property rights. Ultimately achieve the target of legalizing houses with limited property rights. Develop shared-property housing system has a very important significance to optimize China’s housing security system. April 2014, the Ministry of Housing and Urban-Rural Development in Beijing held a forum about the pilot cities of developing shared-property housing, and had put out a statement which Beijing, Shanghai, Shenzhen, Chengdu, Huangshi, Huai’an were listed as pilot cities. This also approved the paper that developing the shared-property housing, and thus further proved the great feasibility of the paper.
