On The Application Of Criminal Conciliation In The Judicial Practice Of China

In China to implement criminal conciliation, it is good for its promoting localization todig the local culture to provide local resources.The author mainly uses documentary research, research activities, interview methodand other research done on the subject. The thesis introduces judicial practice of criminalconciliation in China, analysis its superiority, shortcoming, basis in China. On this basis, thethesis discuses a specific criminal mechanism of criminal conciliation in China.Criminal conciliation also has its shortcomings. However, comparing with the traditionalcriminal justice system, it has special advantages in sovling the crime problems and disputes,restoring social relations. Our Chinese Judicial Organ has made some positive explorations onhow the Criminal conciliation is applied in the judicial practice, which plays an important rolein repairing the harmonious relationship of persons concerned and realizing social orderstability. However, there are also some problems which need our further study, such as theappliable condition, the host institution, the monitoring mechanisms the suitable procedures,the appliable legal consequences, supporting systems and so on.
