| The perfection of juvenile justice is one of measures of judging the level of somecountries' legal civilization, also provides the experience for the development ofcriminal justice for adults.With the background in which a judicial system for juvenileis far from being mature, a concept of "supportive working system for juvenilejustice" is constructed as a reasonable alternative in this paper.This"supportiveworking system" might be a pragmatic scheme, which is affiliated to criminal justicefor adults, until the juvenile justice is institutionalized.Completion of supportiveworking system requires constant exploration and experiment of reform to juvenilejustice. During this long course,a variety of obstacles and problems may come out,therefore,we need rational judgment and reflection to deal with the said obstacles.Juvenile justice has the idea of "Educational Penalty".It is undoubtedly thatjuvenile justice has been operating independently from the judicial system foradults.Bottom-up strategy is necessary at the initial stage of independence of Juvenilejustice. However,a full-fledged Juvenile justice as well as an advanced model will notbe achieved unless completion of institutionalization which is indispensable oftop-down promotion from decision makers and the leadership of a substantive strongorgan.The paper consists of five chapters. Chapter one clarifies the definition,content and position of "supportive workingsystem for Juvenile justice".By tracing the history of the system, this chapter alsofigures out the aims of it and argues that the "dual-dragon" pattern might be the futurechoice of the supportive system.Chapter two points out that criminal policies have assigned significant role inreconstruction of Juvenile justice through reflecting on the past Juvenile criminaljudicial policies. In an addition to it, this chapter demonstrates that both this articleand the 'supportive system' are underpinned by the values of Juvenile justice that arewidely accepted around the world.Chapter three revolves the keyword of 'supportive'. This chapter reveals several"hard"and "soft" problems with the field of reformation of Juvenile judicial.Furthermore,the importance of inter-departmental cooperation is explored in thischapter.Chapter four uses the metaphor of "dragon"(i.e. dragon's head, body and tail) toillustrate the continuos line between politics and justice. On the basis of this metaphor,several measures are introduced as suggestions of reformation of the"supportivesystem". As well, an exploration of social dragon is discussed in this chapter.Chapter five concludes that the three emerging judicial ideas coincide with thecore value of "supportive system". Despite a lot of difficulties, the "supportivesystem" has an optimistic future as the emerging judicial ideas has. |
